Abstract

Law Number 1 of 2023 concerning the Criminal Code introduced the concept of the conditional
death penalty through Article 100, which provides for a ten-year probationary period before the
sentence can be executed or commuted. This regulation is intended to be a more humane reform
of criminal law and oriented towards protecting human rights. However, this norm is not
accompanied by clear technical parameters regarding the mechanisms and standards for
assessing the attitudes, behavior, and remorse of convicts during the probationary period. This
study aims to analyze the legal implications of this lack of technical parameters for the principle
of legal certainty in the Indonesian criminal law system. This study uses a normative juridical
method with a statutory and conceptual approach. The results show that the absence of
measurable assessment indicators and the absence of implementing regulations have the
potential to lead to subjective and inconsistent interpretations in judicial practice. This situation
opens up room for excessive discretion for law enforcement officials and risks giving rise to
substantive injustice, especially considering that the death penalty concerns the fundamental
right to life. Therefore, this study emphasizes the need for further regulations that formulate
clear technical parameters and evaluation mechanisms to ensure that the implementation of
Article 100 of the National Criminal Code aligns with the principles of legal certainty and
human rights protection.
